Article R5463-2 of the French Public Health Code

Placing on the market, holding with a view to sale, selling or distributing free of charge a personal music player that does not comply with the conditions laid down in article L. 5232-1 and the regulations adopted for its application is punishable by a fifth-class fine.

Natural persons guilty of the offence provided for in this article shall be liable to the additional penalty of confiscation of the item used or intended for use in committing the offence.

Est puni de l’amende prévue pour les contraventions de la cinquième classe le fait de mettre sur le marché, de détenir en vue de la vente, de vendre ou de distribuer à titre gratuit un baladeur musical non conforme aux conditions fixées par l’article L. 5232-1 et par les textes réglementaires pris pour son application.

Les personnes physiques coupables de la contravention prévue au présent article encourent la peine complémentaire de confiscation de la chose qui a servi ou était destinée à commettre l’infraction.
