Article R549-1 of the French Monetary and Financial Code

Where the applicant applies for authorisation to provide one or more data communication services within the meaning ofArticle L. 323-1, such authorisation shall be granted as part of the authorisation procedure as an investment service provider other than an asset management company.

Where the applicant has been authorised as an investment service provider other than an asset management company and is applying for authorisation to provide one or more data communication services within the meaning of Article L. 323-1, such authorisation shall be granted as part of the amendment to its authorisation in accordance with the procedure laid down in Articles L. 532-3-1 and R. 532-6.

Article R549-1

Lorsque le requérant demande un agrément comportant l’autorisation de fournir un ou plusieurs services de communication de données au sens de l’article L. 323-1, cette autorisation est délivrée dans le cadre de la procédure d’agrément comme prestataire de services d’investissement autre qu’une société de gestion de portefeuille.

Lorsque le requérant a été agréé en qualité de prestataire de service d’investissement autre qu’une société de gestion de portefeuille et qu’il demande l’autorisation de fournir un ou plusieurs services de communication de données au sens de l’article L. 323-1, cette autorisation est délivrée dans le cadre de la modification de son agrément conformément à la procédure prévue aux articles L. 532-3-1 et R. 532-6.
