I. – The persons mentioned in 1° to 7°c of Article L. 561-2 shall inform the department mentioned in Article L. 561-23 and their supervisory authority designated in Article L. 561-36 of the identity of their managers or agents authorised to make the declarations prescribed in Article L. 561-15.
For the other persons mentioned in Article L. 561-2, the identity and capacity of the person authorised to make this declaration shall be communicated by means of a separate document, attached to the first declaration sent to the department mentioned in Article L. 561-23 pursuant to Article L. 561-15.
II. – Any change concerning the persons authorised pursuant to I, who are known as declarants, must be brought to the attention of this department and their supervisory authority, where applicable, without delay.
III. – Any manager of a legal entity referred to in Article L. 561-2 or an employee of such a legal entity may take the initiative of making a declaration to the department referred to in Article L. 561-23, in exceptional cases, in particular because of the urgency of the matter, concerning a transaction that he or she feels should be declared pursuant to Article L. 561-15. This declaration shall be confirmed as soon as possible by the authorised person.
IV. – The persons referred to in 12° to 13° and 19° of Article L. 561-2 shall personally fulfil the reporting obligation referred to in Article L. 561-15, regardless of the manner in which they carry out their professional activities.
