Article R561-38-2 of the French Monetary and Financial Code

The persons mentioned in 1° to 7°c of Article L. 561-2 may entrust an external service provider with the performance, in their name and on their behalf, of all or part of the activities relating to the obligations incumbent upon them under this chapter, with the exception of the reporting obligations set out in Article L. 561-15.

They shall remain responsible for compliance with their obligations.

A contract between the external service provider and the person mentioned in the first paragraph shall be concluded in writing to define the terms and conditions of outsourcing.

An order of the Minister for the Economy shall specify the mandatory clauses of this contract.

Les personnes mentionnées aux 1° à 7° quater de l’article L. 561-2 peuvent confier à un prestataire externe la réalisation, en leur nom et pour leur compte, de tout ou partie des activités relatives aux obligations qui leur incombent au titre du présent chapitre, à l’exception des obligations déclaratives prévues à l’article L. 561-15.

Elles demeurent responsables du respect de leurs obligations.

Un contrat entre le prestataire externe et la personne mentionnée au premier alinéa est conclu par écrit pour définir les conditions et modalités d’externalisation.

Un arrêté du ministre chargé de l’économie précise les clauses obligatoires de ce contrat.
