Article R591-7 of the French Code governing the entry and residence of foreign nationals and the right of asylum

In the case provided for in Article R. 591-6, for the application of the provisions of Chapter I of Title III:

1° In article R. 531-2, the words: “twenty-one days” are replaced by the words: “seven days” and after the words: “to lodge”, the words: “in person” are added;

2° In Article R. 531-4, the words: “eight days” are replaced by the words: “three days”;

3° In article R. 531-5, the words: “the French Office for the Protection of Refugees and Stateless Persons acknowledges receipt” are replaced by the words: “the French Office for the Protection of Refugees and Stateless Persons informs the applicant, by hand-delivered letter, that the application is complete”;

4° Article R. 531-6 reads as follows:

“Art. R. 531-6.-The French Office for the Protection of Refugees and Stateless Persons takes a decision within twenty-one days of the application being submitted”;

5° Article R. 531-7 is worded as follows:

“Art. R. 531-7.-The French Office for the Protection of Refugees and Stateless Persons may decide not to rule within the period provided for in Article R. 531-6 where it considers this necessary to ensure that the application is properly examined. “

6° In Article R. 531-11, the words: “under the conditions provided for in Article R. 531-17” are replaced by the words: “by hand-delivery of the summons when the complete asylum application is lodged”;

7° Article R. 531-17 is amended as follows:

a) The words: “by registered letter with acknowledgement of receipt” are replaced by the words: “by hand-delivery against receipt by an official of the Office”;

b) A new paragraph is inserted before the last paragraph: “In order to enable the notification to be made by hand delivery referred to in the previous paragraph, the applicant shall be given a summons, against receipt, when submitting his/her application or following the interview provided for in article R. 531-11. The Office’s decision is deemed to have been notified on the date on which the applicant was summoned if, without a legitimate reason, he or she did not attend this summons.”

Article R591-7

Dans le cas prévu à l’article R. 591-6, pour l’application des dispositions du chapitre I du titre III :

1° A l’article R. 531-2, les mots : ” vingt-et-un jours ” sont remplacés par les mots : ” sept jours ” et après les mots : ” pour introduire “, sont ajoutés les mots : ” en personne ” ;

2° A l’article R. 531-4, les mots : ” huit jours ” sont remplacés par les mots : ” trois jours ” ;

3° A l’article R. 531-5, les mots : ” l’Office français de protection des réfugiés et apatrides en accuse réception ” sont remplacés par les mots : ” l’Office français de protection des réfugiés et apatrides informe le demandeur, par lettre remise en mains propres, du caractère complet du dossier ” ;

4° L’article R. 531-6 est ainsi rédigé :

” Art. R. 531-6.-L’Office français de protection des réfugiés et apatrides statue dans un délai de vingt-et-un jours à compter de l’introduction de la demande ” ;

5° L’article R. 531-7 est ainsi rédigé :

” Art. R. 531-7.-L’Office français de protection des réfugiés et apatrides peut décider de ne pas statuer dans le délai prévu à l’article R. 531-6 lorsque cela lui paraît nécessaire pour assurer un examen approprié de la demande. ” ;

6° A l’article R. 531-11, les mots : “ dans les conditions prévues à l’article R. 531-17 ” sont remplacés par les mots : “ par remise en mains propres de la convocation lors de l’introduction de la demande d’asile complète ” ;

7° L’article R. 531-17 est ainsi modifié :

a) Les mots : “ par lettre recommandée avec demande d’avis de réception ” sont remplacés par les mots : “ par remise en mains propres contre récépissé par un agent de l’office ” ;

b) Avant le dernier alinéa est inséré un alinéa ainsi rédigé : “ Afin de permettre la notification par remise en mains propres mentionnée à l’alinéa précédent, le demandeur se voit remettre contre récépissé une convocation, lors de l’introduction de sa demande ou à l’issue de l’entretien prévu à l’article R. 531-11. La décision de l’office est réputée notifiée à la date à laquelle le demandeur a été convoqué si, sans motif légitime, il ne s’est pas présenté à cette convocation ”.
