Article R611-19 of the French Commercial code

As soon as the application is received, the president of the court shall have the court clerk summon the legal representative of the legal entity or the debtor who is a natural person in order to obtain his observations.

The order appointing the mandataire ad hoc shall define the purpose of his mission, specifying, if the debtor is an entrepreneur, the activity concerned, and shall set the terms of his remuneration in accordance with the provisions of section 5 of this chapter.

Dès réception de la demande, le président du tribunal fait convoquer, par le greffier, le représentant légal de la personne morale ou le débiteur personne physique pour recueillir ses observations.

L’ordonnance qui désigne le mandataire ad hoc définit l’objet de sa mission en précisant, si le débiteur est un entrepreneur, l’activité concernée et fixe les conditions de sa rémunération conformément aux dispositions de la section 5 du présent chapitre.
