Article R611-19 of the French Intellectual Property Code

Proceedings for the grant of the patent shall be suspended at the written request of any person who furnishes proof that he has instituted before the judicial court an action claiming ownership of the patent application.

The suspension of proceedings shall take effect from the day on which the justification is provided; however, it shall not prevent the application of Article R. 612-39.

Proceedings for the grant of the patent shall be resumed as soon as the court’s decision has become res judicata; they may also be resumed at any time with the written consent of the person who brought the action claiming ownership of the patent application; such consent shall be irrevocable.

The suspension and resumption of proceedings shall be entered in the National Patent Register.

La procédure de délivrance du brevet est suspendue à la requête écrite de toute personne qui apporte la justification qu’elle a intenté auprès du tribunal judiciaire une action en revendication de la propriété de la demande de brevet.

La suspension de la procédure prend effet du jour où la justification est apportée ; toutefois, elle ne fait pas obstacle à l’application de l’article R. 612-39.

La procédure de délivrance du brevet est reprise dès que la décision du tribunal est passée en force de chose jugée ; elle peut également être reprise à tout moment sur le consentement écrit de la personne qui a intenté l’action en revendication de propriété de la demande de brevet ; ce consentement est irrévocable.

La suspension et la reprise de la procédure sont inscrites au Registre national des brevets.
