I.-When the Director General of the Regional Health Agency establishes, after comparing the needs as they result from the section of the regional health plan dedicated to the organisation of permanent care with the list provided for in Article R. 6111-48, that the permanent care mission referred to in Article L. 6111-1-3 is not being carried out under the conditions provided for, he opens a procedure for a call for candidates.
He publishes this call for candidates in the Recueil des actes administratifs of the regional prefecture. The call is also made public on the Regional Health Agency’s website, where it remains until the call closes.
II – When the Director General of the Regional Health Agency establishes that there is an urgent need to provide permanent care, he may designate, on a temporary basis, one or more health establishments providing the public hospital service, in application of 2° of III of article L. 6112-2, to provide this service in order to guarantee the continuity of the public service while awaiting the results of the procedure defined in I, which is opened within a maximum period of twelve months. The elements mentioned in 1° to 7° of article R. 6111-43 are specified in the multiannual contract of objectives and resources provided for in article L. 6114-1 or in a specific contract.
