Article R612-45 of the French Intellectual Property Code

The patent application shall be rejected if:

1° It has not been completed within the time limits laid down in Articles R. 612-8 (fifth paragraph), R. 612-11 (sixth paragraph), R. 612-21 and R. 612-35 (sixth paragraph);

2° The filing and research report fees referred to in Articles R. 612-5 and R. 612-54 have not been paid within the prescribed period.

The rejection decision is notified to the applicant, who has a period of two months from the date of receipt of the notification to submit observations or pay the fees due as referred to in 2° of this article by paying the corresponding fee plus the prescribed surcharge. The rejection decision is final if the applicant has neither contested the irregularity or failure to pay nor paid the fee plus a surcharge within the prescribed period.

La demande de brevet est rejetée si :

1° Elle n’a pas été complétée dans les délais prévus aux articles R. 612-8 (cinquième alinéa), R. 612-11 (sixième alinéa), R. 612-21 et R. 612-35 (sixième alinéa) ;

2° Les redevances de dépôt et de rapport de recherche mentionnées aux articles R. 612-5 et R. 612-54 n’ont pas été acquittées dans le délai prescrit.

La décision de rejet est notifiée au demandeur qui dispose d’un délai de deux mois à compter de la date de réception de la notification pour présenter des observations ou payer les redevances exigibles visées au 2° du présent article en acquittant la redevance correspondante majorée du supplément prescrit. La décision de rejet est définitive si le demandeur n’a, dans le délai prescrit, ni contesté l’irrégularité ou le défaut de paiement ni acquitté la redevance majorée d’un supplément.
