Article R612-48 of the French Intellectual Property Code

Where the applicant has been invited, pursuant to Article R. 612-33, to divide his application, he may, within the period provided for in that Article, submit written observations in which he refutes the objection made by the National Institute of Industrial Property.

If the applicant has not submitted observations, or if he has not limited his claims or if the patent application has not been divided, the application shall be rejected.

If the observations submitted by the applicant are not accepted, or if the new claims do not satisfy the provisions of article L. 612-4, he shall be notified thereof. If the division or limitation of the claims of the initial application is not carried out within the new time limit set, the application shall be refused.

Lorsque le demandeur a été invité, en application de l’article R. 612-33, à diviser sa demande, il peut, dans le délai prévu à cet article, présenter par écrit des observations dans lesquelles il réfute l’objection faite par l’Institut national de la propriété industrielle.

Si le demandeur n’a pas présenté d’observations, ou s’il n’a pas limité ses revendications ou si la demande de brevet n’a pas été divisée, la demande est rejetée.

Si les observations présentées par le demandeur ne sont pas retenues, ou si les nouvelles revendications ne permettent pas de satisfaire aux dispositions de l’article L. 612-4, notification lui en est faite. Dans le cas où la division ou la limitation des revendications de la demande initiale n’est pas effectuée dans le nouveau délai qui lui est imparti, la demande est rejetée.
