Article R6144-5-1 of the French Public Health Code

The duties of the chairman of the hospital medical board end when he resigns and submits his resignation to the chairman of the hospital board or when the term of office of the hospital medical board that elected him expires.

If the chairman of the hospital medical board is prevented from attending, is absent for a prolonged period or resigns, his duties on the hospital medical board are assumed by the vice-chairman of this board until a new chairman is appointed.

The duties of chairman of the hospital medical committee are incompatible with those of head of department. However, the internal regulations may provide for an exception to this rule if this is justified by the establishment’s medical staff. Notwithstanding the sixth paragraph of article R. 6144-4, when a department head is elected chairman of the committee and loses his position as department head during his term of office, he continues to hold the position of chairman.

Les fonctions de président de la commission médicale d’établissement prennent fin sur présentation de sa démission au président du directoire ou au terme du mandat de la commission médicale d’établissement qui l’a élu.

En cas d’empêchement, d’absence prolongée ou de démission du président de la commission médicale d’établissement, ses fonctions au sein de la commission médicale d’établissement sont assumées par le vice-président de cette commission jusqu’à la désignation d’un nouveau président.

Les fonctions de président de la commission médicale d’établissement sont incompatibles avec les fonctions de chef de pôle. Toutefois le règlement intérieur peut prévoir une exception à cette règle si l’effectif médical de l’établissement le justifie. Par dérogation au sixième alinéa de l’article R. 6144-4, lorsqu’un chef de pôle est élu président de la commission et qu’il perd en cours de mandat la qualité de chef de pôle, il continue d’exercer son mandat de président.
