The duties of the chairman of the hospital medical board end when he resigns and submits his resignation to the chairman of the hospital board or when the term of office of the hospital medical board that elected him expires.
If the chairman of the hospital medical board is prevented from attending, is absent for a prolonged period or resigns, his duties on the hospital medical board are assumed by the vice-chairman of this board until a new chairman is appointed.
The duties of chairman of the hospital medical committee are incompatible with those of head of department. However, the internal regulations may provide for an exception to this rule if this is justified by the establishment’s medical staff. Notwithstanding the sixth paragraph of article R. 6144-4, when a department head is elected chairman of the committee and loses his position as department head during his term of office, he continues to hold the position of chairman.
