Article R6145-14 of the French Public Health Code

The appropriations entered in the budget are assessed, with the exception of those entered in a list of titles or chapters, drawn up by order of the ministers responsible for health, social security and the budget, which are limited.

The accounting officer’s control of the availability of restrictive appropriations is carried out at the level of each of the titles or chapters in the list referred to in the previous paragraph.

When, in application of the third paragraph of Article L. 6145-1 or Article L. 6145-2 or Article L. 6131-5, the Director General of the Regional Health Agency adopts the budget, the restrictive nature of the appropriations is assessed at the level of each chapter.

Article R6145-14

Les crédits inscrits au budget présentent un caractère évaluatif, à l’exception de ceux inscrits sur une liste de titres ou de chapitres, fixée par arrêté des ministres chargés de la santé, de la sécurité sociale et du budget, qui présentent un caractère limitatif.

Le contrôle de la disponibilité des crédits limitatifs par le comptable s’effectue au niveau de chacun des titres ou chapitres de la liste mentionnée à l’alinéa précédent.

Lorsque, en application du troisième alinéa de l’article L. 6145-1 ou de l’article L. 6145-2 ou de l’article L. 6131-5, le directeur général de l’agence régionale de santé arrête le budget, le caractère limitatif des crédits s’apprécie au niveau de chaque chapitre.
