Article R6146-3 of the French Public Health Code

In the interests of the service, the duties of the head of the department may be terminated by a joint decision of the director and the chairman of the hospital medical committee, after consulting, in the case of university hospitals, the director of the medical training and research unit and the chairman of the medical education coordination committee.

When the head of the department is an army practitioner, the decision to terminate his duties is taken under the conditions set out in the first paragraph jointly by the Minister for Defence, the director and the chairman of the establishment medical committee. However, in the interests of the public hospital service or to meet the specific needs of defence, the Minister for Defence alone, or the Director and the Chairman of the Establishment Medical Commission jointly, may terminate the appointment directly. The agreement provided for in article L. 6147-9 shall be terminated or amended as soon as possible.

Il peut être mis fin dans l’intérêt du service aux fonctions de chef de pôle par décision conjointe du directeur et du président de la commission médicale d’établissement après avis, pour les centres hospitaliers universitaires, du directeur de l’unité de formation et de recherche médicale et du président du comité de coordination de l’enseignement médical.

Lorsque le chef de pôle est un praticien des armées, la décision de mettre fin à ses fonctions est prise dans les conditions fixées au premier alinéa conjointement par le ministre de la défense, le directeur et le président de la commission médicale d’établissement. Toutefois, dans l’intérêt du service public hospitalier ou pour répondre aux besoins spécifiques de la défense, le ministre de la défense seul, ou le directeur et le président de la commission médicale d’établissement conjointement, peuvent y mettre fin directement. La convention prévue à l’article L. 6147-9 est résiliée ou modifiée dans les meilleurs délais.
