Article R6152-4-1 of the French Public Health Code

The agreement referred to in the third paragraph of article R. 6152-4 may be concluded for the implementation of a territorial solidarity scheme involving the allocation of compensation to full-time hospital practitioners who carry out shared activity in excess of their service obligations in several public health establishments. The agreement is signed by the partner establishments after approval by the Director General of the Regional Health Agency.

Practitioners who do not work full-time may, by decision of the Director General of the Regional Health Agency taken on a proposal from the director of the establishment, benefit from the arrangement referred to in the first paragraph.

The Director General of the Regional Health Agency may, after consulting the joint regional commission, set, for each establishment and each speciality, an increase or decrease in the amount of the territorial solidarity bonus set up as part of the scheme referred to in the first paragraph, under conditions laid down by order of the ministers responsible for the budget and health.

The activity carried out under the territorial solidarity scheme is organised under the conditions defined by article R. 6152-27.

Article R6152-4-1

La convention mentionnée au troisième alinéa de l’article R. 6152-4 peut être conclue pour la mise en œuvre d’un dispositif de solidarité territoriale comportant l’attribution d’une compensation aux praticiens hospitaliers exerçant à temps plein qui réalisent une activité partagée au-delà de leurs obligations de service dans plusieurs établissements publics de santé. La convention est signée par les établissements partenaires après approbation par le directeur général de l’agence régionale de santé.

Les praticiens n’exerçant pas à temps plein peuvent, sur décision du directeur général de l’agence régionale de santé prise sur proposition du directeur de l’établissement, bénéficier du dispositif mentionné au premier alinéa.

Le directeur général de l’agence régionale de santé peut, après avis de la commission régionale paritaire, fixer, par établissement et par spécialité, une majoration ou une minoration du montant de la prime de solidarité territoriale mise en place dans le cadre du dispositif mentionné au premier alinéa, dans des conditions fixées par arrêté des ministres chargés du budget et de la santé.

L’activité réalisée au titre du dispositif de solidarité territoriale est organisée dans les conditions définies par l’article R. 6152-27.
