Article R6152-918 of the French Public Health Code

An associate practitioner suffering from tuberculosis, mental illness, cancer, severe and acquired immunodeficiency or poliomyelitis and unable to carry out his duties is entitled, after receiving the opinion of the medical committee mentioned in article R. 6152-36, to long-term leave for a maximum of twenty-four months per condition, in periods not exceeding six months.

In this situation, he receives the full emoluments mentioned in 1° of article R. 6152-912.

If, at the end of this leave, he is unable to resume his activities, he is granted, at his request, unpaid leave related to his state of health, for a maximum period of eighteen months.

On expiry of the entitlement to long-term leave or unpaid leave for health reasons, the medical committee shall rule on the fitness of the person concerned to perform his duties.

Le praticien associé atteint de tuberculose, de maladie mentale, d’affection cancéreuse, de déficit immunitaire grave et acquis ou de poliomyélite et empêché d’exercer ses fonctions a droit, après avis du comité médical mentionné à l’article R. 6152-36, à un congé de longue durée pour une durée maximale de vingt-quatre mois par affection, par périodes ne pouvant excéder six mois.

Dans cette situation, il perçoit la totalité des émoluments mentionnés au 1° de l’article R. 6152-912.

Si, à l’issue de ce congé, il ne peut reprendre ses activités, il lui est accordé sur sa demande un congé sans rémunération lié à l’état de santé, d’une durée maximale de dix-huit mois.

A l’expiration des droits à congé de longue durée ou d’un congé sans rémunération lié à l’état de santé, le comité médical se prononce sur l’aptitude de l’intéressé à ses fonctions.
