Article R6153-41 of the French Public Health Code

In the event that a position in an approved structure likely to be offered to an intern or resident has not been offered to interns or residents, or if it has not been chosen, the director of the health establishment may, on the proposal of the head of the department or, failing this, the head of the service, of the functional unit or any other internal structure concerned, decide to call upon a doctor, medical student, pharmacist or pharmacy student belonging to one of the categories mentioned in article R. 6153-43.

The list of unfilled posts for interns or residents located in centres or structures approved in application of article 30 of decree no. 2004-67 of 16 January 2004 relating to the organisation of the third cycle of medical studies or article 3 of decree no. 88-996 of 19 October 1988 relating to specialised studies in the third cycle of pharmacy studies is communicated to the director general of the regional health agency, who may authorise the assignment to these posts of persons belonging to the categories mentioned in 1° and 2° of article R. 6153-42.

The assignment is decided by the director of the health care establishment, on the proposal of the head of the division or, failing that, the head of the department, the functional unit or any other internal structure concerned. The director of the health care organisation informs the doctor or pharmacist appointed by the Director General of the Regional Health Agency.

Students or practitioners acting as interns are appointed for a period running from the date on which the interns take up their duties until the date corresponding to the end of their probationary period. This period may then be renewed every six months.

The provisions of this article do not apply to dental internships.

Dans le cas où un poste, dans une structure agréée, susceptible d’être offert à un interne ou à un résident n’a pu être mis au choix des internes ou des résidents, ou s’il n’a pas été choisi, le directeur de l’établissement de santé peut, sur proposition du chef de pôle ou, à défaut, du responsable de service, de l’unité fonctionnelle ou de toute autre structure interne intéressée, décider de faire appel, pour occuper provisoirement ce poste en tant que faisant fonction d’interne, à un médecin, un étudiant en médecine, un pharmacien ou à un étudiant en pharmacie appartenant à l’une des catégories mentionnées à l’article R. 6153-43.

La liste des postes non pourvus d’internes ou de résidents situés dans des pôles ou structures agréés en application de l’article 30 du décret n° 2004-67 du 16 janvier 2004 relatif à l’organisation du troisième cycle des études médicales ou de l’article 3 du décret n° 88-996 du 19 octobre 1988 relatif aux études spécialisées du troisième cycle de pharmacie est communiquée au directeur général de l’agence régionale de santé, qui peut autoriser l’affectation sur ces postes de personnes appartenant aux catégories mentionnées aux 1° et 2° de l’article R. 6153-42.

L’affectation est décidée par le directeur de l’établissement de santé, sur proposition du chef de pôle ou, à défaut, du responsable de service, de l’unité fonctionnelle ou de toute autre structure interne intéressée. Le directeur de l’établissement de santé informe le médecin ou le pharmacien de l’agence régionale de santé désigné par le directeur général de l’agence régionale de santé.

Les étudiants ou praticiens faisant fonction d’interne sont nommés pour une durée allant de la prise de fonctions des internes jusqu’à la date correspondant à la fin de leur période de stage. Cette durée peut être ensuite renouvelée tous les six mois.

Les dispositions du présent article ne s’appliquent pas aux postes d’interne en odontologie.
