The derogation provided for, on public health grounds, in Article L. 6211-16, under which the taking of a biological sample is carried out in one of the health territories in which the medical biology laboratory is located, applies to the following cases:
1° (Repealed) ;
2° To the taking of a biological sample for a periodic health examination mentioned in articles L. 321-3 and R. 321-5 of the Social Security Code and for which the analytical phase is carried out in a medical biology laboratory of a health examination centre operated by a health insurance organisation or by a non-profit organisation;
3° The taking of a biological sample from a patient’s home when the patient’s condition justifies it and when the analytical phase of the medical biology examination is carried out in a health territory bordering on that in which the patient’s territory is located;
4° The taking of biological samples from patients hospitalised in a health establishment, when the analytical phase of the medical biology examination is carried out in a medical biology laboratory which, although located in a neighbouring health territory, is closer to the health establishment than any other laboratory located in the same health territory as the health establishment;
5° The taking of a biological sample from a newborn as part of neonatal screening for the examinations provided for in Article R. 1131-2.
