I.-When one or more medical biology laboratory sites created before the revision of the regional health plan or before the change in the delimitation of the zones defined in b of 2° of Article L. 1434-9 no longer meet the location conditions set by Article L. 6222-5 or to the forecasts for the location of sites indicated by the regional health plan in application of 4° of I of Article L. 1434-3, the Director General of the regional health agency shall notify the legal representative of the laboratory concerned of this incompatibility within three months of the publication of the acts revising the plan or changing the boundaries of the zones.
The legal representative of the laboratory shall submit a reasoned request to the Director General of the Regional Health Agency to maintain the site or sites concerned, within three months of receipt of the notification referred to in the previous paragraph.
The Director General of the Regional Health Agency may agree to the maintenance, on a temporary or permanent basis, of the site or sites concerned, in one of the following cases:
1° When maintaining the site is the only way to preserve the specific nature of the biology offer in the area concerned;
2° When maintaining the site is the only way to meet the needs of the population in this area.
II – The Director General of the Regional Health Agency, after examining the reasons for the request, will respond to the legal representative of the laboratory within three months of receiving the request, stating in a reasoned decision whether the site or sites in question may be maintained and for what period of time.
