Article R6223-45 of the French Public Health Code

Without prejudice to the obligation to sell his shares under the conditions provided for in article R. 6223-30, a member struck off the roll of an association or who has been subject to one of the criminal penalties mentioned in articles L. 6242-1 and L. 6242-2 or who is excluded from the company pursuant to the provisions of article R. 6223-44 loses the rights attached to the status of member, with the exception of the remuneration relating to his capital contributions. These provisions take effect, depending on the case, on the day on which the decision to deregister becomes final, on the day of notification of the withdrawal of authorisation or on the day of notification of the decision to exclude.

Sans préjudice de l’obligation de céder ses parts sociales dans les conditions prévues à l’article R. 6223-30, l’associé radié du tableau d’un ordre ou qui a fait l’objet d’une des sanctions pénales mentionnées aux articles L. 6242-1 et L. 6242-2 ou qui exclu de la société en application des dispositions de l’article R. 6223-44 perd les droits attachés à la qualité d’associé à l’exception des rémunérations afférentes à ses apports en capital. Ces dispositions prennent effet, selon le cas, au jour où la décision de radiation est devenue définitive, au jour de la notification du retrait d’autorisation ou de la notification de la décision d’exclusion.
