Article R623-36 of the French Intellectual Property Code

Renunciation of a plant variety certificate is made by means of a written declaration. It is formulated to the person in charge of the missions of the national plant variety authority by the owner of the certificate or by a representative with a special power of attorney. If the certificate belongs to several persons, renunciation may only be made if it is requested by all of them.

If the real, pledge or licence rights have been entered in the National Register of Plant Variety Certificates, renunciation is only admissible if it is accompanied by the consent of the holders of these rights.

Renunciation is entered after payment of the cancellation fee to the National Register of Plant Variety Certificates. It takes effect on the date of this entry.

La renonciation à un certificat d’obtention végétale est faite par une déclaration écrite. Elle est formulée au responsable des missions relevant de l’instance nationale des obtentions végétales par le propriétaire du certificat ou par un mandataire muni d’un pouvoir spécial. Si le certificat appartient à plusieurs personnes, la renonciation ne peut être effectuée que si elle est requise par l’ensemble de celles-ci.

Si les droits réels, de gage ou de licence ont été inscrits au Registre national des certificats d’obtention végétale, la renonciation n’est recevable que si elle est accompagnée du consentement des titulaires de ces droits.

La renonciation est inscrite après le versement de la redevance de radiation au Registre national des certificats d’obtention végétale. Elle prend effet à la date de cette inscription.
