Article R623-5 of the French Intellectual Property Code

The applicant must attach to the application for a plant variety certificate:

1° A declaration stating:

-that the variety for which protection is sought constitutes to his knowledge a new variety within the meaning of Article L. 623-1;

-that it has not been offered for sale or marketed in France or in the territory of the European Economic Area with the agreement of the breeder or his successor(s) for more than twelve months at the date of the application ;

that it has not been offered for sale or marketed with the agreement of the breeder in the territory of any other State for more than six years in the case of vines, forest trees, fruit trees and ornamental trees, including in each case their rootstocks, or for more than four years in the case of other genera or species ;

2° Where applicable, if the application relates to a variety whose commercial production requires the repeated use of a protected variety, the written authorisation of the holder of the plant variety certificate to use that protected variety ;

3° An undertaking to provide, at the request of the person in charge of the missions under the authority of the national plant variety authority, within the time limits he shall set, on pain of rejection of the application, the reproductive or vegetative propagating material of the variety intended to enable an examination of the said variety, including, where applicable, the various hereditary components necessary for the reproduction of the variety;

4° Where applicable, the power of attorney;

5° Proof of payment of the fees due at the time of filing of the application.

Article R623-5

Le déposant doit joindre à la demande de certificat d’obtention végétale :

1° Une déclaration affirmant :

-que la variété pour laquelle la protection est demandée constitue à sa connaissance une obtention au sens de l’article L. 623-1 ;

-qu’elle n’a pas été offerte à la vente ou commercialisée en France ou sur le territoire de l’Espace économique européen avec l’accord de l’obtenteur ou de son ou de ses ayants cause depuis plus de douze mois à la date de la demande ;

-qu’elle n’a pas été offerte à la vente ou commercialisée avec l’accord de l’obtenteur sur le territoire de tout autre Etat depuis plus de six ans dans le cas de la vigne, des arbres forestiers, des arbres fruitiers et des arbres d’ornement, y compris dans chaque cas leurs porte-greffes, ou depuis plus de quatre ans dans le cas des autres genres ou espèces ;

2° Le cas échéant, si la demande porte sur une variété dont la production commerciale exige l’emploi répété d’une variété protégée, l’autorisation écrite du titulaire du certificat d’obtention végétale d’utiliser cette variété protégée ;

3° L’engagement de fournir à la requête du responsable des missions relevant de l’instance nationale des obtentions végétales dans les délais qu’il fixe, sous peine de rejet de la demande, le matériel de reproduction ou de multiplication végétative de la variété destiné à permettre un examen de ladite variété, y compris, le cas échéant, les différents composants héréditaires nécessaires à la reproduction de la variété ;

4° Eventuellement, le pouvoir du mandataire ;

5° La justification du paiement des redevances exigibles au moment du dépôt de la demande.
