Article R631-26 of the French Commercial code

The order issued by the official receiver pursuant to article L. 631-17 indicates the number of employees whose redundancy is authorised as well as the activities and professional categories concerned.

The order is notified to the social and economic committee or, where applicable, to the employees’ representative. It is forwarded to the public prosecutor, the administrator and the judicial representative.

L’ordonnance rendue par le juge-commissaire en application de l’article L. 631-17 indique le nombre des salariés dont le licenciement est autorisé ainsi que les activités et catégories professionnelles concernées.

L’ordonnance est notifiée au comité social et économique ou, le cas échéant, au représentant des salariés. Elle est transmise au ministère public, à l’administrateur et au mandataire judiciaire.
