Where the Autorité des marchés financiers is unable to provide an authority of another Member State of the European Union or party to the Agreement on the European Economic Area exercising similar powers with the assistance that the latter requests pursuant to Article L. 632-16, it shall notify the AMF of the reasons for its refusal and, if the refusal is based on the existence of criminal proceedings or a final decision relating to the same facts, it shall provide the AMF with as much detailed information as possible about the proceedings or the final decision in question.
Where the AMF considers that the practices referred to in I of Article L. 621-14 have been carried out on the territory of another Member State of the European Union or party to the Agreement on the European Economic Area, or involve financial instruments traded on a regulated market in another Member State, it shall inform the competent authority of that State and, without prejudice to the latter’s powers, shall forward to it the details of the measures taken. The Autorité des marchés financiers shall discuss with the competent authority of that State the action to be taken.
When a competent authority of another Member State of the European Union or party to the Agreement on the European Economic Area asks the Autorité des marchés financiers to conduct an investigation, it may request that its investigators be authorised to accompany those of the Autorité des marchés financiers. The investigation remains under the control of the Autorité des marchés financiers.
