Article R632-6 of the French Code governing the entry and residence of foreign nationals and the right of asylum

If the foreign national summoned in accordance with the conditions set out in articles R. 632-3, R. 632-4 and R. 632-5 does not appear in person before the Expulsion Board on the scheduled date, the Board will issue its opinion.
However, it will postpone consideration of the case to a later date, in accordance with the provisions of the fourth paragraph of article L. 632-2, if the foreign national or his or her counsel have submitted a request for postponement based on a legitimate reason during the period between notification of the notice provided for in article R. 632-3 and the start of the committee meeting. This request for referral may also be made during the committee meeting through the foreign national’s counsel.

Article R632-6

Si l’étranger convoqué dans les conditions prévues aux articles R. 632-3, R. 632-4 et R. 632-5 ne se présente pas personnellement devant la commission d’expulsion à la date prévue, celle-ci émet son avis.
Toutefois, elle renvoie l’examen de l’affaire à une date ultérieure, conformément aux dispositions du quatrième alinéa de l’article L. 632-2, lorsque l’étranger ou son conseil ont présenté, pendant la période comprise entre la notification du bulletin prévu à l’article R. 632-3 et le début de la séance de la commission, une demande de renvoi fondée sur un motif légitime. Cette demande de renvoi peut également être formulée au cours de la séance de la commission par l’intermédiaire du conseil de l’étranger.
