Article R6323-14-1 of the French Labour Code

I.-When the request for funding is submitted by the employee referred to in article R. 6323-11-1, the regional inter-professional joint committee may decide to fund the project even when the associated training action begins after the end of the employment contract, provided that it begins no later than six months after the end of the employment contract.

II -For the duration of their professional transition project, the workers mentioned in I have the status of professional training trainees.

They will receive the remuneration set out in article L. 6323-17-5 and will continue to be covered by the social security, unemployment insurance and supplementary pension schemes from which they benefited when they held a fixed-term employment contract. The regional cross-industry joint committee pays the social security contributions relating to these guarantees to the schemes concerned.

Article R6323-14-1

I.-Lorsque la demande de prise en charge est présentée par le salarié mentionné à l’article R. 6323-11-1, la commission paritaire interprofessionnelle régionale peut décider de prendre en charge le projet même quand l’action de formation associée débute après le terme du contrat de travail, à la condition toutefois qu’elle débute au plus tard six mois après celui-ci.

II.-Pendant la durée de son projet de transition professionnelle, le travailleur mentionné au I a la qualité de stagiaire de la formation professionnelle.

Il bénéficie de la rémunération prévue à l’article L. 6323-17-5 ainsi que du maintien du régime de protection sociale dont il bénéficiait lorsqu’il était titulaire d’un contrat de travail à durée déterminée, en matière de sécurité sociale, d’assurance chômage et de retraite complémentaire. La commission paritaire interprofessionnelle régionale verse aux régimes concernés les cotisations sociales afférentes à ces garanties.
