Article R6325-2 of the French Public Health Code

I.-In the organisations referred to in article R. 6325-1, the holding, control, management and dispensing of medicinal products are carried out by a pharmacist registered on the roll of the competent section of the national order of pharmacists.

II – By way of derogation, at the request of the organisation, the Director General of the Regional Health Agency may authorise a doctor, designated by name, who is responsible for the health activities of the centre or structure with mobile care teams, to order, hold, monitor and manage medicines and to be responsible for dispensing them free of charge to patients.

If the Director General of the Agency remains silent, this will be deemed to be authorisation on expiry of a period of two months from the date of receipt of this application.

III – The medicinal products are kept in a place to which persons not belonging to the organisation do not have free access and are stored under the conditions laid down in the marketing authorisation, under the responsibility of the pharmacist or doctor authorised by the Director General of the Agency.

Article R6325-2

I.-Dans les organismes mentionnés à l’article R. 6325-1, la détention, le contrôle, la gestion et la dispensation des médicaments sont assurés par un pharmacien inscrit au tableau de la section compétente de l’ordre national des pharmaciens.

II.-A titre dérogatoire, sur demande de l’organisme, le directeur général de l’agence régionale de santé peut autoriser un médecin, nommément désigné, responsable de l’action sanitaire du centre ou de la structure disposant d’équipes mobiles de soins, à assurer la commande, la détention, le contrôle et la gestion des médicaments et à être responsable de leur dispensation gratuite aux malades.

Le silence gardé par le directeur général de l’agence vaut autorisation à l’expiration d’un délai de deux mois à compter de la date de réception de cette demande.

III.-Les médicaments sont détenus dans un lieu où n’ont pas librement accès les personnes étrangères à l’organisme et conservés dans les conditions prévues par l’autorisation de mise sur le marché, sous la responsabilité du pharmacien ou du médecin autorisé par le directeur général de l’agence.
