Article R6351-5 of the French Labour Code

The declaration of activity must be accompanied by the following supporting documents:

1° A copy of the proof of attribution of the SIREN number;

2° Bulletin no. 3 of the criminal record of the director in the case of legal entities, or of the declarant in the case of natural persons;

3° A copy of the first vocational training agreement relating to one of the actions contributing to the development of skills provided for in article L. 6313-1, or the first vocational training contract provided for in article L. 6353-3, or, if applicable, an apprenticeship contract when the company has a company apprentice training centre mentioned in I of article L. 6241-2.

4° For legal entities under private law which provide apprenticeship training, with the exception of company apprentice training centres, a copy of their articles of association.

5° Information relating to the content of the courses, their organisation and the technical and teaching resources used, where this information does not appear on the documents produced in application of 3°, as well as a list of the people involved in carrying out the course, stating their qualifications, the link between these qualifications and the service provided in accordance with Article L. 6352-1 and the contractual link between them and the organisation.

In order to assess the conformity of the declaration of activity, the authorities may request evidence relating to the first training service provided, the beneficiary public or the nature of this service.

In order to assess whether the declaration complies with the provisions of article L. 6352-1, it may also request documentary evidence relating to the qualifications of the persons involved in the provision of the service and the relationship between these qualifications and the service provided.

The request for additional supporting documents provided for in the two previous paragraphs is sent to the organisation within ten days of receipt of the documents mentioned in 1° to 5° of this article. The organisation has fifteen days from receipt of the request to provide the supporting documents.

La déclaration d’activité est accompagnée des pièces justificatives suivantes :

1° Une copie du justificatif d’attribution du numéro SIREN ;

2° Le bulletin n° 3 du casier judiciaire du dirigeant pour les personnes morales ou celui du déclarant pour les personnes physiques ;

3° Une copie de la première convention de formation professionnelle relative à une des actions concourant au développement des compétences prévues à l’article L. 6313-1, ou du premier contrat de formation professionnelle prévu à l’article L. 6353-3, ou, s’il y a lieu, d’un contrat d’apprentissage lorsque l’entreprise dispose d’un centre de formation d’apprentis d’entreprise mentionné au I de l’article L. 6241-2.

4° Pour les personnes morales de droit privé qui dispensent des actions de formation par apprentissage, à l’exception des centres de formation d’apprentis d’entreprise, une copie de leurs statuts.

5° Les informations relatives au contenu des actions, à leur organisation et aux moyens techniques et pédagogiques mobilisés lorsque ces informations ne figurent pas sur les pièces produites en application du 3°, ainsi que la liste des personnes qui interviennent dans la réalisation de l’action avec la mention de leurs titres et qualités, du lien entre ces titres et qualités et la prestation réalisée conformément à l’article L. 6352-1 et du lien contractuel qui les lie à l’organisme.

L’administration peut demander, pour l’appréciation de la conformité de la déclaration d’activité un justificatif relatif à la première prestation de formation réalisée, au public bénéficiaire ou à la nature de cette prestation.

Elle peut aussi demander, pour l’appréciation de la conformité de cette déclaration aux dispositions de l’article L. 6352-1, un justificatif relatif aux titres et qualités des personnes qui interviennent dans la réalisation de la prestation et à la relation entre ces titres et qualités et la prestation.

La demande de justificatifs complémentaires prévue aux deux alinéas précédents est adressée à l’organisme dans le délai de dix jours à compter de la réception des pièces mentionnées aux 1° à 5° du présent article. L’organisme dispose d’un délai de quinze jours à compter de la réception de la demande pour fournir les justificatifs.
