Article R6523-26 of the French Labour Code

The Employment, Training and Vocational Guidance Committee shall set up a bureau comprising the representative of the State, the President of the Territorial Council, a representative of the trade union organisations representing employees at national and cross-industry level and a representative of the professional employers’ organisations representing employers at national and cross-industry level.

The representatives of the representative employees’ trade unions and employers’ professional organisations are appointed on the proposal of the college made up of all the persons appointed under 3° of article R. 6523-26. In the event that no agreement can be reached on this appointment within a period of one month from the date of referral to this effect of the members concerned by the representative of the State, the latter designates, for the choice of the two members of the bureau, the employees’ trade union organisation and the employers’ professional organisation whose audience, measured in accordance with the provisions of Titles II and V of Book I of Part Two, is the largest.

Le comité de l’emploi, de la formation et de l’orientation professionnelles constitue en son sein un bureau comprenant le représentant de l’Etat, le président du conseil territorial, un représentant des organisations syndicales de salariés représentatives au plan national et interprofessionnel et un représentant des organisations professionnelles d’employeurs représentatives au plan national et interprofessionnel.

Les représentants des organisations syndicales de salariés et des organisations professionnelles d’employeurs représentatives sont désignés sur proposition du collège constitué par l’ensemble des personnes nommées au titre du 3° de l’article R. 6523-26. Dans le cas où aucun accord ne peut être obtenu sur cette désignation dans le délai d’un mois à compter de la saisine à cet effet des membres concernés par le représentant de l’Etat, celui-ci désigne, pour le choix des deux membres du bureau l’organisation syndicale de salariés et l’organisation professionnelle d’employeurs dont l’audience, mesurée suivant les dispositions des titres II et V du livre Ier de la deuxième partie est la plus forte.
