Article R711-34 of the French Commercial code

When the importance of an establishment, work or service managed by a territorial chamber of commerce and industry exceeds its financial resources, its management or operation may be entrusted to the regional chamber of commerce and industry to which this managing establishment is attached;

This decision is taken, as appropriate:

1° By the supervisory authority, under the reinforced supervision of articles R. 712-10 and R. 712-11, with the agreement of the grantor if the grantor is not the State;

The terms of the transfer are then recorded in an appendix to a prefectoral order;

2° Or by decisions of the chambers concerned adopted under the same terms, with the agreement of the grantor.

The terms of the transfer are then specified by an agreement submitted for approval to the supervisory authority under the conditions of 7° of Article R. 712-7.

If necessary, the sectoral plan and the mission organisation plan are updated to take account of this transfer.

Article R711-34

Lorsque l’importance d’un établissement, ouvrage ou service géré par une chambre de commerce et d’industrie territoriale excède ses moyens financiers, la gestion ou l’exploitation peut en être confiée à la chambre de commerce et d’industrie de région à laquelle cet établissement gestionnaire est rattaché ;

Cette décision est prise, suivant le cas :

1° Par l’autorité de tutelle, dans le cadre de la tutelle renforcée des articles R. 712-10 et R. 712-11, avec l’accord du concédant si celui-ci n’est pas l’Etat ;

Les modalités du transfert sont alors inscrites en annexe d’un arrêté préfectoral ;

2° Ou par décisions des chambres concernées adoptées dans les mêmes termes, avec l’accord du concédant.

Les modalités du transfert sont alors précisées par une convention soumise à l’approbation de l’autorité de tutelle dans les conditions du 7° de l’article R. 712-7.

Si nécessaire, le schéma sectoriel et le schéma d’organisation des missions sont actualisés pour tenir compte de ce transfert.
