Goods and services shall be designated with sufficient clarity and precision to enable any person to determine, on that basis alone, the scope of protection.
Goods and services shall be classified in accordance with the system established by the Nice Agreement Concerning the International Classification of Goods and Services for the Purposes of the Registration of Marks of 15 June 1957.
The use of general terms, including the general indications contained in the class headings of the Nice Classification, shall be interpreted as including all goods or services clearly falling within the literal meaning of the indication or term.
The fact that goods or services belong to the same class or to different classes shall have no bearing on the assessment of their identity or similarity.
The procedures for designating and classifying goods or services shall be specified by decision of the Director General of the National Institute of Industrial Property.
