Article R713-53 of the French Commercial code

The committee shall total up, in each jurisdiction, the number of votes obtained by each candidate in each professional category or sub-category and allocate the seats in accordance with article L. 713-16.

Any ballot paper presented in a form other than that validated by the committee, any ballot paper containing more names than there are seats to be filled in the professional category and, where applicable, sub-category and any ballot paper tainted by one of the irregularities mentioned in Article L. 66 of the electoral code.

All votes cast for a person who is not a candidate shall be considered invalid.

The ballot papers and envelopes found to be invalid shall be kept, initialled by the members of the committee and appended to the minutes under the conditions laid down by Articles L. 66 and R. 68 of the electoral code.

Article R713-53

La commission totalise, dans chaque ressort, le nombre de suffrages obtenus par chaque candidat de chaque catégorie ou sous-catégorie professionnelles et attribue les sièges conformément à l’article L. 713-16.

Est considéré comme nul tout bulletin présenté sous une forme autre que celle qui a été validée par la commission, tout bulletin comportant un nombre de noms supérieur à celui des sièges à pourvoir dans la catégorie et, le cas échéant, la sous-catégorie professionnelle et tout bulletin entaché d’une des irrégularités mentionnées à l’article L. 66 du code électoral.

Est considéré comme nul tout suffrage désignant une personne qui n’est pas candidate.

Les bulletins et les enveloppes entachés de nullité sont conservés, paraphés par les membres de la commission et annexés au procès-verbal dans les conditions prévues par les articles L. 66 et R. 68 du code électoral.
