The examination provided for in Article R. 712-10 is limited to verifying the suitability of the sign to constitute a trade mark or to be adopted as a trade mark. Where the international registration concerns a collective mark or a guarantee mark, it is also verified that the mark cannot be refused pursuant to Articles L. 715-4 and L. 715-9.
The four-month period within which notifications of irregularity must be issued, in accordance with Article R. 712-11 (2°), shall run from the date of notification to the Institut national de la propriété industrielle of the extension of the international registration to France.
Irregularities shall be notified to the holder of the international registration via the International Bureau of the World Intellectual Property Organization.
