Article R717-9 of the French Intellectual Property Code

The European Union trade mark or the European Union trade mark application is converted into a French trade mark application as soon as the Institut national de la propriété industrielle receives the conversion request sent to the European Union Intellectual Property Office. It is given a national number.

1° The applicant shall be given a period of time in which to provide:

a) The application for registration provided for in 1° of Article R. 712-3 ;

b) Proof of payment of the fees provided for in a of 2° of Article R. 712-3;

c) The French translation, if applicable, of the conversion request and the attachments thereto;

d) In the case of a collective mark or guarantee mark, the regulations determining the conditions to which the use of the mark is subject.

If the applicant does not have his domicile or registered office in a Member State of the European Union or in a State party to the Agreement on the European Economic Area, he must, within the same period, appoint a representative satisfying the conditions laid down in Article R. 712-2 and communicate the name and address of the latter to the National Institute of Industrial Property;

2° The application resulting from the request for conversion shall be rejected if the documents referred to in 1° are not filed within the prescribed period;

3° Where the application resulting from the request for conversion is recognised as admissible, it shall be published in the Official Bulletin of Industrial Property within six weeks following receipt by the National Institute of Industrial Property of the documents referred to in 1°. Subject to the provisions of the third paragraph of Article L. 717-5, mention is made of the option open to any interested party to submit observations within a period of two months and to the persons mentioned in Article L. 712-4-1 to file an opposition to registration within the same time limit.

La marque de l’Union européenne ou la demande de marque de l’Union européenne est transformée en demande de marque française dès la réception par l’Institut national de la propriété industrielle de la requête en transformation adressée à l’Office de l’Union européenne pour la propriété intellectuelle. Un numéro national lui est attribué.

1° Un délai est imparti au demandeur pour fournir :

a) La demande d’enregistrement prévue au 1° de l’article R. 712-3 ;

b) La justification du paiement des redevances prévue au a du 2° de l’article R. 712-3 ;

c) La traduction en français, s’il y a lieu, de la requête en transformation et des pièces jointes à celle-ci ;

d) S’il s’agit d’une marque collective ou d’une marque de garantie, le règlement déterminant les conditions auxquelles est subordonné l’usage de la marque.

Si le demandeur n’a pas son domicile ou son siège dans un Etat membre de l’Union européenne ou dans un Etat partie à l’accord sur l’Espace économique européen, il doit, dans le même délai, constituer un mandataire satisfaisant aux conditions prévues à l’article R. 712-2 et communiquer le nom et l’adresse de celui-ci à l’Institut national de la propriété industrielle ;

2° La demande issue de la requête en transformation est rejetée si les pièces mentionnées au 1° ne sont pas produites dans le délai prescrit ;

3° Lorsque la demande issue de la requête en transformation est reconnue recevable, elle est publiée au Bulletin officiel de la propriété industrielle dans les six semaines qui suivent la réception par l’Institut national de la propriété industrielle des pièces visées au 1°. Sous réserve des dispositions du troisième alinéa de l’article L. 717-5, mention y est faite de la faculté ouverte à toute personne intéressée de formuler des observations dans le délai de deux mois et aux personnes mentionnées à l’article L. 712-4-1 de former dans ce même délai opposition à enregistrement.
