Article R7213-12 of the French Labour Code

In the event of dismissal, resignation or death of the employee, the indemnities provided for in articles R. 7213-9 to R. 7213-11 are payable under the conditions determined by articles L. 3141-28 to L. 3141-30, relating to holiday indemnities following termination of the employment contract, and in article D. 3141-9 when the employer is required to join a paid holiday fund.

En cas de licenciement, de démission ou de décès du salarié, les indemnités prévues par les articles R. 7213-9 à R. 7213-11 sont dues dans les conditions déterminées par les articles L. 3141-28 à L. 3141-30, relatifs aux indemnités de congés consécutives à la rupture du contrat de travail, et à l’article D. 3141-9 lorsque l’employeur est tenu d’adhérer à une caisse de congés payés.
