Article R7232-8 of the French Labour Code

Applications for renewal must be submitted no later than three months before the end of the approval period to the Prefect of the département in which the main establishment of the legal entity or sole trader is located.

Each approved and certified organisation will automatically have its previous approval renewed, provided that all its activities and establishments are covered by a certification as defined in article L. 433-3 of the Consumer Code. This certification must be based on a personal services reference framework that complies with the requirements set out in the specifications referred to in 2° of article R. 7232-6. The compliance of each certifying body’s reference framework with the specifications is recognised by an order of the Minister for the Economy, which is published in the Official Bulletin of the Ministry for the Economy.

La demande de renouvellement est déposée, au plus tard, trois mois avant le terme de la période d’agrément auprès du préfet du département du lieu d’implantation du principal établissement de la personne morale ou de l’entrepreneur individuel.

Chaque organisme agréé et certifié bénéficie d’un renouvellement automatique de son précédent agrément à condition que l’ensemble de ses activités et établissements concernés soient couverts par une certification telle que définie à l’article L. 433-3 du code de la consommation. Cette certification doit être fondée sur un référentiel des services à la personne qui respecte les exigences fixées par le cahier des charges mentionné au 2° de l’article R. 7232-6. La conformité du référentiel de chaque organisme certificateur au cahier des charges est reconnue par un arrêté du ministre chargé de l’économie, qui est publiée au Bulletin officiel du ministère en charge de l’économie.
