Article R733-12 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When the first president of the court of appeal or his delegate does not intend to dismiss the statement of appeal as manifestly inadmissible, the clerk of the court of appeal informs the parties and the public prosecutor of the date and time of the hearing on the merits.
The administrative authority, the foreign national’s lawyer and the foreign national himself may ask to be heard at the hearing. Lorsque le premier président de la cour d’appel ou son délégué n’envisage pas de rejeter la déclaration d’appel comme manifestement irrecevable, le greffier de la cour d’appel fait connaître aux parties et au ministère public la date et l’heure de l’audience au fond.
L’autorité administrative, l’avocat de l’étranger et l’étranger lui-même peuvent demander à être entendus à l’audience. Le ministère public peut, quant à lui, faire connaître son avis.
