Article R7343-104 of the French Labour Code

The expert, who may be a natural person or a legal entity:

1° Provides proof of insurance to cover its liability and, in the case of a legal entity, of its legal status;

2° Has the organisational, human and material resources to carry out its expert appraisal assignments;

3° Conducts its expert appraisals in accordance with the rules of professional ethics, in particular with regard to confidentiality, liability and the prevention of conflicts of interest. It will forward to the Employment Platforms Social Relations Authority any documents attesting, where applicable, to a special link, in particular a commercial link, with the platforms, the self-employed workers using them for their activity or the organisations representing them;

4° Undertakes not to offer any services related to the conclusions of the expert assessment once it has been completed.

L’expert, qui peut être une personne physique ou une personne morale :


1° Justifie d’une assurance destinée à couvrir sa responsabilité ainsi que, lorsqu’il s’agit d’une personne morale, de son statut juridique ;


2° Dispose des moyens organisationnels, humains et matériels permettant de réaliser ses missions d’expertise ;


3° Conduit ses expertises selon des règles de déontologie professionnelle, notamment en matière de confidentialité, de responsabilité et de prévention des conflits d’intérêts. Il transmet à l’Autorité des relations sociales des plateformes d’emploi tout document attestant, le cas échéant, d’un lien particulier, notamment commercial, existant avec les plateformes, les travailleurs indépendants y recourant pour leur activité ou les organisations qui les représentent ;


4° S’engage à ne pas proposer, à l’issue de l’expertise, des prestations en rapport avec les conclusions de celles-ci.
