Article R742-14 of the French Consumer Code

Where the claims have been declared in the hands of the trustee, the trustee shall, within six months of the publication of the opening judgment, draw up the debtor’s economic and social balance sheet.

This balance sheet includes a statement of claims and, where applicable, a proposed plan including the measures mentioned in articles L. 733-1, L. 733-4 et L. 733-7.

It is sent to the debtor and the creditors by registered letter with acknowledgement of receipt and sent by ordinary letter or delivered to the clerk’s office of the judicial court. Upon receipt, the clerk’s office shall summon the debtor and the creditors for a ruling to be made in accordance with the procedures set out in Article R. 742-17.

Lorsque les créances ont été déclarées entre les mains du mandataire, celui-ci dresse, dans le délai de six mois à compter de la publicité du jugement d’ouverture, le bilan économique et social du débiteur.

Ce bilan comprend un état des créances et, le cas échéant, une proposition de plan comportant les mesures mentionnées aux articles L. 733-1, L. 733-4 et L. 733-7.

Il est adressé au débiteur et aux créanciers par lettre recommandée avec demande d’avis de réception et adressé par lettre simple ou remis au greffe du tribunal judiciaire. A sa réception, le greffe convoque le débiteur et les créanciers pour qu’il soit statué selon les modalités prévues à l’article R. 742-17.
