Article R743-139-14 of the French Commercial code

The Chairman or Vice-Chairman of the National Council, after hearing the parties concerned and gathering all relevant information, shall propose a solution to the dispute if the parties have been unable to reach an agreement.

In the event of an agreement, whether total or partial, this shall be recorded in writing, signed by the parties concerned and the Chairman or Vice-Chairman. The original is kept by the Chairman; a copy is given to each of the parties.

If no agreement is reached, or in the event of partial agreement, the Chairman or Vice-Chairman draws up minutes stating the solution he proposes and the points remaining in dispute. He shall give a copy to each of the parties.

The case may only be referred to the industrial tribunal, on pain of inadmissibility, if the claimant provides proof of the prior mediation attempt by submitting a copy of the minutes provided for in the third paragraph.

Le président ou le vice-président du Conseil national, après avoir entendu les intéressés et recueilli toutes informations utiles, propose, si les parties n’ont pu se rapprocher, une solution au litige.

En cas d’accord, total ou partiel, celui-ci est constaté par écrit, signé par les intéressés et le président ou le vice-président. L’original est conservé par le président ; une copie est remise à chacune des parties.

Si aucun accord n’est intervenu, ou en cas d’accord partiel, le président ou le vice-président dresse un procès-verbal mentionnant la solution qu’il propose et les points demeurant en litige. Il en donne une copie à chacune des parties.

Le conseil de prud’hommes ne peut être saisi, à peine d’irrecevabilité, que si le demandeur justifie de la tentative de médiation préalable par une remise d’une copie du procès-verbal prévu au troisième alinéa.
