The holder of the office refers the matter to the chairman of the commission by registered letter with acknowledgement of receipt. The letter of referral shall specify the reasons given in support of the proposed dismissal. A copy of the letter is sent to the President of the Conseil national des greffiers des tribunaux de commerce, to the Minister of Justice, by tele-procedure on the website of the Ministry of Justice, and to the Public Prosecutor at the Court of Appeal in whose jurisdiction the office has its registered office.
The parties are summoned at least eight days before the date set for the committee meeting. A copy of the letter of referral is attached to the summons sent to the employee registrar.
The parties appear in person before the committee. They may be assisted by counsel.
