Article R752-44 of the French Commercial code

1° For shops and commercial complexes:

a) The sales area referred to, as appropriate, in a, b, d or e of 1° of I of Article R. 752-6, before and after completion of the project, with, where applicable, details of the sales area of each business whose sales area reaches or exceeds 300 m2 , before and after completion of the project;

b) The sector of activity mentioned, as appropriate, in a, b, d or e of 1° of I of the same article, before and after completion of the project, of each business whose sales area reaches or exceeds 300 m2 ;

c) The number of parking spaces mentioned in g of 1° of I of the same article, before and after completion of the project, with mention of spaces dedicated to electric or hybrid vehicles, car-pooling, car-sharing, and non-impervious spaces;

2° For permanent points for the collection by customers of retail purchases ordered electronically, organised for access by car, the number of refuelling lanes and the square metres of floor space allocated to the collection of goods, mentioned in c of 1° of I of the same article, before and after completion of the project;

3° For all commercial facilities:

a) The total surface area of the site where the project is to be located and the cadastral references of the parcel or parcels of land mentioned in b of 2° of I of the same article;

b) The number and directions of access and egress points to and from the site, before and after completion of the project, as illustrated by the maps and plans mentioned in b, c and d of 2° of I of the same article ;

c) The surface area of the site given over to the green spaces mentioned in b of 2° of I of the same article, as well as, where applicable, the surface area and nature of the other vegetated surfaces, particularly on roofs, and of the other non-sealed surfaces, with mention of any materials or processes used for this purpose, with a view to limiting soil sealing in accordance with the provisions of d of 4° of the same I ;

d) Where applicable, the surface area and location of photovoltaic panels, as well as the number and location of wind turbines or any other renewable energy device integrated into the project pursuant to b of 4° of I of the same article;

e) Any other elements, intrinsic or related to the project, that may be expressly mentioned by the commercial development commission to justify its favourable opinion or authorisation.

All these elements are summarised in the table attached to the opinion or decision of the commercial development commission, mentioned in articles R. 752-16 and R. 752-38.

Article R752-44

Pour tout projet réalisé en exécution d’une autorisation d’exploitation commerciale, la conformité à cette autorisation s’apprécie au regard des éléments caractéristiques du projet suivants :

1° Pour les magasins et ensembles commerciaux :

a) La surface de vente mentionnée, selon les cas, au a, b, d ou e du 1° du I de l’article R. 752-6, avant et après réalisation du projet, avec, le cas échéant, le détail de la surface de vente de chaque commerce dont la surface de vente atteint ou dépasse 300 m2, avant et après réalisation du projet ;

b) Le secteur d’activité mentionné, selon les cas, au a, b, d ou e du 1° du I du même article, avant et après réalisation du projet, de chaque commerce dont la surface de vente atteint ou dépasse 300 m2 ;

c) Le nombre de places de stationnement mentionnées au g du 1° du I du même article, avant et après réalisation du projet, avec mention des places dédiées aux véhicules électriques ou hybrides, au co-voiturage, à l’auto-partage, et des places non imperméabilisées ;

2° Pour les points permanents de retrait par la clientèle d’achats au détail commandés par voie électronique, organisés pour l’accès en automobile, le nombre de pistes de ravitaillement et les mètres carrés d’emprise au sol affectés au retrait des marchandises, mentionnés au c du 1° du I du même article, avant et après réalisation du projet ;

3° Pour l’ensemble des équipements commerciaux :

a) La superficie totale du lieu d’implantation du projet et les références cadastrales, de la ou des parcelles de terrain mentionnées au b du 2° du I du même article ;

b) Le nombre et les sens de circulation des points d’accès et de sortie du site, avant et après réalisation du projet, tels qu’illustrés par les cartes et plans mentionnés aux b, c et d du 2° du I du même article ;

c) La superficie du site consacrée aux espaces verts mentionnés au b du 2° du I du même article, ainsi que, le cas échéant, la superficie et la nature des autres surfaces végétalisées, notamment en toiture, et des autres surfaces non imperméabilisées, avec mention des matériaux ou procédés éventuellement utilisés pour ce faire, aux fins de limiter l’imperméabilisation des sols conformément aux dispositions du d du 4° du même I ;

d) Le cas échéant, la superficie et la localisation des panneaux photovoltaïques, ainsi que le nombre et la localisation des éoliennes ou de tout autre dispositif d’énergie renouvelable intégré au projet en application du b du 4° du I du même article ;

e) Tous les autres éléments, intrinsèques ou connexes au projet, éventuellement mentionnés expressément par la commission d’aménagement commercial pour motiver son avis favorable ou son autorisation.

Tous ces éléments sont récapitulés dans le tableau joint à l’avis ou à la décision de la commission d’aménagement commercial, mentionné aux articles R. 752-16 et R. 752-38.
