Article R8114-6 of the French Labour Code

Once the interested party has accepted, the Regional Director for Business, Competition, Consumer Affairs, Labour and Employment forwards the settlement file to the Public Prosecutor for approval.

As soon as the public prosecutor has approved the proposed settlement, the administrative authority will notify the offender of the settlement, by any means that can be used to establish a date certain, so that it can be implemented. This notification initiates the deadlines for fulfilling the obligations set out in the settlement.

Après acceptation de l’intéressé, le directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi transmet le dossier de transaction au procureur de la République pour homologation.

Dès que l’homologation du procureur de la République sur la proposition de transaction est intervenue, l’autorité administrative notifie celle-ci à l’auteur de l’infraction, par tout moyen permettant d’établir date certaine, pour exécution. Cette notification fait courir les délais d’exécution des obligations prévues par la transaction.
