Article R821-19 of the French Commercial code

I. – When the High Council concludes that acts contrary to the statute governing statutory auditors or to the rules governing the practice of statutory auditing have been committed on the territory of another Member State of the European Union, its Chairman shall inform the competent authority of that State, specifying the reasons that led him to this conclusion and the factual elements that gave rise to it.

Where the High Council is informed by a competent authority that such acts have been committed on French territory, it shall take appropriate measures and inform that authority of the action taken in response to its request.

II. – The General Rapporteur may ask the authority of a Member State exercising powers similar to those of the High Council to conduct an investigation on the territory of that State. He may also request that staff of the High Council be authorised to accompany those of the competent authority of that State in the course of the investigation.

He shall inform the Chairman of the High Council of any such request.

I. – Lorsque le Haut conseil conclut que des actes contraires au statut régissant les commissaires aux comptes ou aux règles gouvernant l’exercice du commissariat aux comptes ont été commis sur le territoire d’un autre Etat membre de l’Union européenne, son président en informe l’autorité compétente de cet Etat en précisant les motifs qui l’ont conduit à cette conclusion et les éléments de fait qui en sont à l’origine.

Lorsque le Haut conseil est informé par une autorité compétente que de tels actes ont été commis sur le territoire français, il prend les mesures appropriées et informe cette autorité des suites données à sa demande.

II. – Le rapporteur général peut demander à l’autorité d’un Etat membre exerçant des compétences analogues à celles du Haut conseil d’effectuer une enquête sur le territoire de cet Etat. Il peut également demander que des agents du Haut conseil soient autorisés à accompagner ceux de l’autorité compétente de cet Etat au cours de l’enquête.

Il informe le président du Haut conseil de cette demande.
