Article R824-5 of the French Commercial code

The investigator may summon and hear any person likely to be able to provide him with any information useful to the accomplishment of his mission.

The summons shall be sent to the person concerned at least eight days before the date of the hearing, unless the person concerned waives this deadline. It shall refer to the mission order and remind the person summoned that he or she may be assisted by counsel of his or her choice.

A report shall be drawn up of the hearing. The person heard may record his or her observations on the minutes. The minutes are signed by the person concerned and, where applicable, by his or her counsel, as well as by the investigator. If the person concerned refuses to sign, this will be noted in the minutes.

When the investigating officer wishes to hear the person concerned via a video or audio conference system, the summons sent under the conditions provided for in the previous paragraph must mention this, specify that the conference will be recorded and seek the express agreement of the person concerned.

Where the investigating officer has heard the person concerned by means of a video or audio conference system, the audiovisual or sound recording to which these operations give rise shall be the subject of a transcript submitted to the person concerned for signature. This report, together with the recording, is sent to the person concerned within ten days of the date of the videoconference or audioconference. The person concerned may record his observations on the minutes. If the signed minutes are not returned within ten days of receipt by the person heard, mention of the refusal to sign shall be made in the minutes.

A copy of the minutes shall be given to the person heard.

L’enquêteur peut convoquer et entendre toute personne susceptible de lui fournir tout renseignement utile à l’accomplissement de sa mission.

La convocation est adressée à l’intéressé huit jours au moins avant la date de l’audition, sauf renonciation à ce délai par la personne concernée. Elle fait référence à l’ordre de mission et rappelle à la personne convoquée qu’elle peut se faire assister du conseil de son choix.

Il est dressé procès-verbal de l’audition. La personne entendue peut consigner ses observations sur le procès-verbal. Le procès-verbal est signé par l’intéressé et, le cas échéant, par son conseil, ainsi que par l’enquêteur. En cas de refus de signer, mention en est faite au procès-verbal.

Lorsque l’enquêteur souhaite entendre l’intéressé par un système de visioconférence ou d’audioconférence, la convocation adressée dans les conditions prévues par le précédent alinéa doit en faire état, préciser que la conférence sera enregistrée et solliciter l’accord exprès de la personne concernée.

Lorsque l’enquêteur a entendu l’intéressé par un système de visioconférence ou d’audioconférence, l’enregistrement audiovisuel ou sonore auquel ces opérations donnent lieu fait l’objet d’un procès-verbal de transcription soumis pour signature à l’intéressé. A cet effet, ce procès-verbal, accompagné de l’enregistrement, lui est adressé dans un délai de dix jours à compter de la date de la visioconférence ou de l’audioconférence. La personne peut consigner ses observations sur le procès-verbal. En l’absence de retour du procès-verbal signé dans un délai de dix jours à compter de sa réception par la personne entendue, mention du refus de signer est faite au procès-verbal.

Copie du procès-verbal est remise à la personne entendue.
