Court costs are the procedural expenses, to be borne definitively or provisionally by the State, which result from a decision by the judicial authority or by a person acting under its direction or control. They include criminal, correctional and police court costs as well as costs assimilated to them.
Criminal, correctional and police court costs correspond to expenses incurred in the course of criminal proceedings. They are listed in Article R. 92.
Expenses of the nature defined in the first paragraph, incurred in the course of proceedings other than those mentioned in the second paragraph, are treated in the same way. They are listed in Article R. 93.
The State pays the legal costs and pursues the recovery of those that are not definitively borne by it, all in the form and according to the rules established by this title.
The tariffs for legal costs are fixed exclusive of tax.
