Article 1314 of the French Code of civil procedure

If closed documents or packets appear, by their inscription or some other written evidence, to belong to third parties, the bailiff shall deposit them in his office and summon such third parties within a period which he shall fix so that they may attend the opening.

If, during the opening, it is revealed that the documents or packages are extraneous to the estate, the bailiff shall hand them over to the interested parties. If they do not appear or if the documents or packages relate to the estate, the bailiff deposits them in the hands of the notary responsible for settling the estate, or, if there is none, retains them.

Si des documents ou paquets fermés paraissent, par leur suscription ou quelque autre preuve écrite, appartenir à des tiers, l’huissier de justice les dépose en son étude et convoque ces tiers dans un délai qu’il fixe pour qu’ils puissent assister à l’ouverture.

Si, lors de l’ouverture, il se révèle que les documents ou paquets sont étrangers à la succession, l’huissier les remet aux intéressés. Si ceux-ci ne se présentent pas ou si les documents ou paquets se rapportent à la succession, l’huissier de justice les dépose entre les mains du notaire chargé du règlement de la succession, ou, s’il n’y en a pas, les conserve.
