Article 2-10 of the French Code of Criminal Procedure

Any association that has been duly registered for at least five years on the date of the events and that, by virtue of its articles of association, is dedicated to combating the social or cultural exclusion of people living in extreme poverty or because of their family situation, or against substandard housing and accommodation incompatible with human dignity, may exercise the rights granted to civil parties with regard to the discrimination punishable by articles 225-2,225-14 and 432-7 of the Penal Code. However, the association will only be admissible in its action if it can prove that it has received the victim’s agreement or, if the victim is a minor or a protected adult, that of his or her legal representative.

A foundation recognised as being in the public interest may exercise the rights granted to a civil party under the same conditions and subject to the same reservations as the association mentioned in this article.

Article 2-10

Toute association régulièrement déclarée depuis au moins cinq ans à la date des faits ayant, en vertu de ses statuts, vocation à lutter contre l’exclusion sociale ou culturelle des personnes en état de grande pauvreté ou en raison de leur situation de famille ou contre l’habitat insalubre et l’hébergement incompatible avec la dignité humaine, peut exercer les droits reconnus à la partie civile en ce qui concerne les discriminations réprimées par les articles 225-2,225-14 et 432-7 du code pénal. Toutefois l’association ne sera recevable dans son action que si elle justifie avoir reçu l’accord de la victime ou, si celle-ci est un mineur ou un majeur protégé, celui de son représentant légal.

Toute fondation reconnue d’utilité publique peut exercer les droits reconnus à la partie civile dans les mêmes conditions et sous les mêmes réserves que l’association mentionnée au présent article.
