1. In the cases listed in article 2 of law no. 83-1119 of 23 December 1983, the following may be decided, in accordance with the terms and conditions of application laid down by decree in the Conseil d’Etat:
a) A financial levy on ships used by or on behalf of companies that are nationals of the foreign State concerned, during their commercial operations in French ports. The amount, based on the volume of the vessel as defined for the calculation of port and navigation dues, is set at 4.57 euros per cubic metre or fraction of a cubic metre, for a vessel whose volume does not exceed 50,000 cubic metres. For a vessel whose volume exceeds 50,000 cubic metres, 3.05 euros per cubic metre are added for each cubic metre between 50,000 and 100,000 cubic metres and 1.52 euros per cubic metre above 100,000 cubic metres;
b) A financial levy amounting to 30% of their customs value, on goods of French origin or destined for France, transported on board vessels used by or on behalf of companies that are nationals of the foreign State concerned.
2. The calculation and collection of the financial levies provided for in 1 above are carried out by the customs administration in accordance with the rules, guarantees and penalties applicable in customs matters.
