Article 2298 of the French Civil Code

The guarantor may raise against the creditor all defences, personal or inherent in the debt, which belong to the debtor, subject to the provisions of the second paragraph of article 2293.

However, the guarantor may not rely on legal or judicial measures from which the debtor benefits as a consequence of his default, unless there is a special provision to the contrary.

Article 2298

La caution peut opposer au créancier toutes les exceptions, personnelles ou inhérentes à la dette, qui appartiennent au débiteur, sous réserve des dispositions du deuxième alinéa de l’article 2293.


Toutefois la caution ne peut se prévaloir des mesures légales ou judiciaires dont bénéficie le débiteur en conséquence de sa défaillance, sauf disposition spéciale contraire.
