Article 230-10 of the French Code of Criminal Procedure

The specially authorised personnel of the national police and gendarmerie services designated for this purpose as well as the specially authorised personnel of the State invested by law with judicial police powers, in particular the customs officers, tax officers and environmental inspectors mentioned in article L. 172-1 of the Environment Code, may access information, including nominative information, contained in the personal data processing provided for in this section and held by each of these departments. The authorisation shall specify the nature of the data to which access is authorised. Access, by any mobile technical means, to the information contained in the processing of personal data provided for by this section is open only to the personnel of the national police and gendarmerie, customs and tax services and the environmental inspectors mentioned in the same Article L. 172-1.

Access to the information mentioned in the first paragraph is also open to:

1° Public prosecutors;

2° Investigating magistrates, for investigations relating to offences referred to them.

Les personnels spécialement habilités des services de la police et de la gendarmerie nationales désignés à cet effet ainsi que les personnels spécialement habilités de l’Etat investis par la loi d’attributions de police judiciaire, notamment les agents des douanes, les agents des services fiscaux et les inspecteurs de l’environnement mentionnés à l’article L. 172-1 du code de l’environnement, peuvent accéder aux informations, y compris nominatives, figurant dans les traitements de données à caractère personnel prévus par la présente section et détenus par chacun de ces services. L’habilitation précise la nature des données auxquelles elle autorise l’accès. L’accès, par tous moyens techniques mobiles, aux informations figurant dans les traitements de données à caractère personnel prévus par la présente section est ouvert aux seuls personnels de la police et de la gendarmerie nationales, des douanes et des services fiscaux et aux inspecteurs de l’environnement mentionnés au même article L. 172-1.

L’accès aux informations mentionnées au premier alinéa est également ouvert :

1° Aux magistrats du parquet ;

2° Aux magistrats instructeurs, pour les recherches relatives aux infractions dont ils sont saisis.
